By placing an order you are offering to purchase a product on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price.
Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Ordering products from HisSplendour Designs does not license your use of any portion of the content for other purpose other than the finished products supplied by HisSplendour Designs. HisSplendour Designs may terminate its service to clients found to be engaged in objectionable conducts. By placing an order on this website, you confirm that you have all necessary permission, authority and right, and by this HisSplendour Designs can produce the products on your behalf. You will be responsible for the protection of your password and access to your registered account. You will be responsible for all orders placed and/or actions that are taken through your registered account.
Our Contract
When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.
Pricing and Availability
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
Where delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total Cost’.
Payment
Upon receiving your order we carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfil the transaction. Your card will be debited upon authorisation being received. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase. Once the goods have been despatched and you have been sent a confirmation email the monies paid as a deposit shall be used as consideration for the value of goods you have purchased as listed in the confirmation email.
Approvals
Prior to producing your products HisSplendour Designs will present all designs for your final approval. It shall be your sole responsible for approving the final designs. You accept that once you have approved the proof, the Products cannot be changed nor cancelled. HisSplendour Designs shall not be liable for any errors in your approved designs. You can upload your own design files, however HisSplendour Designs shall not be held liable for errors due to inappropriate files upload.
Delivery
Unless there are exceptional circumstances, your products will be dispatched for delivery in accordance with the delivery service chosen by you during the ordering process. Working days are Monday to Friday, excluding public holidays. Where delivery is delayed due to exceptional circumstances, we will complete the work as soon as we reasonably can. Where delivery is not possible as a result of providing us with incorrect delivery details, our delivery service will return the products to us. We reserve the right to bill you for subsequent delivery attempts of the products to the right destination.
All products will be signed for upon delivery. If a products is signed for in proxy and the product is then not delivered to the intended recipient, HisSplendour Designs will not incur any liability in as much as the product was delivered as specified by the client.
Notice for Non-Delivery of Products
You must notify us within 7 days of any failed delivery for further investigation and appropriate action.
Risk
The products will be at your risk from the time of delivery as the ownership of the products is passed to you on delivery.
Our Replacement Policy
If you believe that a product is defective, we may request that you return the product for our examination.
Force Majeure
Neither party shall be liable to the other for any failure to perform any obligation under any Confirmment which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an confirmment or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Confirmment contained herein.
Cancellation Policy and Refunds Policy
MINIMUM 24 hours’ notice of cancellation required. Notification in person, via email, mobile phone “text message” and/or phone call, or any other means will be accepted subject to confirmation in writing. We reserve the right to charge fees to cover all administrative expenses. Both the Client and our company have the right to terminate any Services Confirmment for any reason, including the ending of services that are already underway. No refunds shall be offered, where a Service is considered to have begun and is being processed. Any payment made in respect of the provision of unused Services, shall be refunded.
Disclaimer of Liability
